Welcome to Elevate Marketing Australia. By engaging our services, you agree to the following terms and conditions. Please read them carefully before proceeding.

1. General Terms
1.1. These Terms of Service ("Terms") govern your use of Elevate Marketing Australia's services, including but not limited to Website Development, Social Media Management, and Graphic Design.
1.2. By engaging our services, you agree to provide timely communication, feedback, and materials as necessary for the successful completion of your project.
1.3. Elevate Marketing Australia reserves the right to amend these Terms at any time. Updated Terms will be made available on our website.
1.4. All services provided by Elevate Marketing Australia are subject to these Terms, which supersede any prior agreements or understandings.

2. Website Development
2.1. Timely Feedback and Deliverables:

• You are responsible for providing all requested feedback, content, and materials necessary for the development of your website in a timely manner.

• Elevate Marketing Australia will not be held liable for project delays resulting from untimely communication or failure to provide required materials.

2.2. Ownership:

• Ownership of the website, including its files, design, and functionality, remains with Elevate Marketing Australia until the final payment has been received in full.

• Upon full payment, ownership rights will be transferred to you.

2.3. Payment Terms:

• A payment schedule will be agreed upon before project commencement. Failure to meet payment deadlines may result in project suspension or termination.

• All invoices must be paid within the specified due date. Late payments may incur a fee.

2.4. Hosting and Maintenance:

• Elevate Marketing Australia can provide hosting and maintenance services upon request. These services are subject to additional terms and fees.

• It is your responsibility to manage hosting and domain registration if not arranged through Elevate Marketing Australia.

2.5. Third-Party Tools and Plugins:

• Any third-party tools or plugins integrated into your website will be subject to their respective terms and conditions. Elevate Marketing Australia is not responsible for issues arising from third-party services.

3. Social Media Management
3.1. Notice for Termination:

• A minimum of 14 days' written notice is required to terminate or modify the social media management agreement before the next scheduled debit date.

3.2. Content and Communication:

• You agree to provide all necessary content, images, and other materials required for scheduled posts in advance.

• Elevate Marketing Australia will not be held responsible for delays or omissions in posting due to a lack of communication or failure to provide the required content.

3.3. Service Limitations:

• While Elevate Marketing Australia strives for high-quality service, certain factors outside our control, such as platform outages or algorithm changes, may affect the performance or visibility of posts.

3.4. Performance Metrics:

• Elevate Marketing Australia will provide regular performance reports as agreed upon. However, specific results or outcomes cannot be guaranteed.

4. Graphic Design
4.1. Project Scope and Revisions:

• Elevate Marketing Australia will deliver graphic design work based on the agreed project brief. Any changes outside the original scope may incur additional fees.

• Clients are entitled to a specified number of revisions as agreed upon prior to project commencement. Additional revisions will be charged at an hourly rate.

4.2. Timely Feedback and Deliverables:

• You are responsible for providing feedback and required materials promptly to avoid delays.

• Elevate Marketing Australia will not be held liable for delays caused by untimely feedback or the failure to provide necessary content.

4.3. Ownership:

• Ownership of design files, including but not limited to editable source files, remains with Elevate Marketing Australia until final payment has been made.

• Upon full payment, ownership of agreed deliverables will transfer to the client. Source files may be provided at an additional cost if not included in the project scope.

5. Confidentiality
5.1. Both parties agree to keep all sensitive information confidential and not disclose it to any third party without prior written consent.
5.2. Elevate Marketing Australia may use non-identifiable project information for portfolio or promotional purposes unless otherwise agreed upon in writing.

6. Liability
6.1. Elevate Marketing Australia will not be liable for any indirect, incidental, or consequential damages arising from the use of our services.
6.2. Our total liability for any claim related to our services will not exceed the amount paid for the specific service in question.
6.3. Clients are responsible for ensuring compliance with applicable laws and regulations related to their business operations.

7. Governing Law These Terms shall be governed by and construed in accordance with the laws of Australia.

8. Acceptance By engaging Elevate Marketing Australia, you acknowledge that you have read, understood, and agree to these Terms of Service.
